The filing Thursday in San Francisco federal court seeks a judge’s order requiring Musk to testify, alleging “blatant refusal to comply” with an earlier SEC subpoena. Musk testified twice as part of the SEC’s investigation in July 2022, according to the agency. The SEC served Musk with a subpoena to testify again in the matter in May 2023, according to the court filing. The current subpoena at issue seeks evidence and testimony from Musk that the SEC does not yet possess, the agency said. The SEC attempted to negotiate with Musk to find alternative dates later this fall, according to court documents.

Washington CNN —Former Twitter CEO Jack Dorsey backtracked Saturday on his earlier endorsement of Elon Musk as the right choice to lead the company, speaking out against the billionaire who, for the past six months, has led Twitter through a series of largely self-inflicted crises. A fabricated screenshot purporting to show a tweet published by The Guardian on Twitter CEO Elon Musk has circulated online. The fake screenshot appears to show a tweet published by the British outlet on Dec. 12 supposedly reporting that an audio had been leaked featuring Musk “ranting” about “transgender ideology.”Examples of the fabricated image can be viewed (here) and (here). Web archived versions of The Guardian’s homepage saved on Dec. 12 did not find a similar report either (here), (here). Two current Twitter employees told CNN on Thursday that they plan to reject the ultimatum, citing a toxic work environment they say the billionaire has introduced. Musk told employees his goal is to build “Twitter 2.0” and that employees who choose to stay will be required to commit to working “long hours at high intensity” and presumably agreeing to Musk’s demand for Twitter employees, who have been largely working remotely, to return to in-office work. In less than a week since Musk acquired Twitter, the company’s C-suite appears to have almost entirely cleared out, through a mix of firings and resignations. Musk has also dissolved Twitter’s former board of directors. At the same time, Musk is also running several other companies, including as CEO of Tesla and SpaceX. Musk immediately fired four of Twitter’s top executives — CEO Parag Agrawal, CFO Ned Segal, General Counsel Sean Edgett and Policy Head Vijaya Gadde. It’s unclear whether VP of Operations Lindsey Iannucci, the other two members of Twitter’s top leadership team, will remain with the company.
